Terms & conditions

This document sets out the terms on which FLORIT ARTS CAFE SRL (“Florit”, “we”) provides its services and on which the website floritbucharest.com may be used.

By creating an account, buying a class, a pack or a membership, making a booking or taking part in a class, you confirm that you have read, understood and accept these terms. In the event of any difference between the English and Romanian versions, the Romanian version prevails.

1. Florit’s services

Florit is a movement studio and café in Bucharest, organised in three spaces:

• Sweat — hot mat Pilates, in an infrared-heated room;
• Sculpt — reformer Pilates, in small groups;
• Sip — a café and bar serving food and drink made in house.

Classes last around 50 minutes [PLACEHOLDER: confirm per format]. Florit may change the schedule, formats, instructors and number of places according to availability or operational needs. The current schedule is the one published on the schedule page and in the booking app.

2. Your account and bookings

Classes can only be attended by prior booking, through the Glofox booking platform (the mobile app or the web portal the website links to) or at the studio front desk.

You need an account to book. The details you give when creating it must be accurate and kept up to date. Your account is personal and may not be used by anyone else.

Places in each class are limited and allocated in the order bookings are confirmed. When a class is full you can join the waitlist; if a place frees up you will be notified through the app, your booking becomes active and the same cancellation rules apply to it.

3. Cancellations and no-shows

A booking can be cancelled free of charge at least 8 hours before the class starts [PLACEHOLDER: confirm the cancellation window configured in Glofox]. For morning classes, cancellations must be made by 22:00 the previous day [PLACEHOLDER].

Cancelling after that deadline (a “late cancellation”) or not turning up for a booked class has the following consequences:

• for single classes, packs and memberships with a fixed number of classes, the class is counted as used;
• for unlimited memberships, a no-show fee of [PLACEHOLDER] RON is charged, or, after three no-shows in a month, bookings may be temporarily suspended [PLACEHOLDER: choose the policy].

If Florit cancels a class, the credit is returned to your account automatically.

4. Prices, payment and invoicing

The prices in force are those shown on the pricing page and in the booking platform, in RON, VAT included. If they differ, the price in the booking platform at the time of purchase applies.

You can pay online by card through the booking platform, or at the front desk in cash or by card. Online payments are processed by the Glofox platform’s payment provider over a secure connection; Florit does not store your card details.

Invoices are issued to the details in your account. For an invoice to a company, send the company details to [email protected] before paying.

5. Classes, packs and memberships

Florit offers several kinds of product, described in detail on the pricing page:

• single class — valid on the day you book;
• intro offer — a fixed number of classes for people coming to Florit for the first time, valid for a limited number of days from activation; can be bought once only;
• class packs — a fixed number of classes with a validity period from activation;
• monthly memberships — a number of classes a month, or unlimited access, renewing automatically.

All products are personal and cannot be transferred to anyone else. Classes not used within the validity period are lost and do not carry over, except as set out in section 6.

Monthly memberships renew automatically each billing period at the price then in force, until renewal is switched off. You can stop renewal at any time from your account or by e-mail, at least [PLACEHOLDER: 5] days before the next payment date; the membership stays active until the end of the period already paid for. Unused classes in a month do not carry over to the next.

Promotional codes and discounts cannot be combined unless the campaign says otherwise.

6. Pausing a membership

Monthly memberships can be paused (“frozen”) for at most [PLACEHOLDER: 14] calendar days a year, in blocks of at least 7 days, on written request sent before the pause period. In the case of medically documented illness or injury, the pause can be extended on request. Class packs and single classes cannot be paused.

7. Refunds

Services purchased (classes, packs, memberships) are not refundable, in whole or in part, except where the law expressly provides otherwise.

For contracts concluded at a distance (online) you have, under Romanian Government Emergency Ordinance 34/2014, the right to withdraw within 14 days of purchase without giving a reason, provided the service has not begun. By booking and attending your first class within that period you agree that provision of the service begins, and you accept that once the service has been fully used the right of withdrawal is lost, and that for a partly used service you owe the value of the classes attended at the single-class price.

8. Conditions of participation and your health

You take part in Florit’s classes at your own risk. By booking a class you declare that:

• you are physically and medically fit for moderate to intense exercise;
• you have no condition that prevents you from exercising;
• you have consulted a doctor before starting an exercise programme, if your state of health requires it.

Classes in Sweat take place in an infrared-heated room at around [PLACEHOLDER] °C. Heat puts additional demand on the cardiovascular system. If you have a heart condition, high or low blood pressure, respiratory problems or diabetes, are pregnant or have recently given birth, take medication that affects temperature regulation, or have recently had surgery, consult your doctor before booking a Sweat class and tell the instructor before the class starts.

You must tell the instructor, before every class, about any condition, injury, pregnancy or physical limitation that may affect your participation. The instructor may suggest variations of the exercises, but the decision to take part and the way you perform the exercises remain your responsibility.

Florit may refuse or stop your participation in a class if it considers that it presents a risk to you or to other participants, without the class being counted as used.

Minimum age. Classes are open to people aged 16 and over [PLACEHOLDER]. Minors aged 16 to 18 need the written consent of a parent or guardian, sent before their first class.

9. Assumption of risk

Physical activity carries inherent risks, including but not limited to muscle strains and tears, sprains, dislocations, joint injuries, falls, dizziness, dehydration, loss of consciousness, aggravation of pre-existing conditions and other bodily injury. By taking part in classes you declare that you understand and accept these risks and take part voluntarily.

10. Studio rules

• Arrive at least 10 minutes before the class starts. Once a class has started, entry to the room may be refused and the class counted as used.
• A towel and suitable sportswear are required in Sweat and Sculpt. Grip socks are required on the reformer and in the mat room [PLACEHOLDER: confirm the sock policy and whether socks are sold or hired at the front desk].
• Use the equipment as the instructor directs. Damage to equipment caused by negligence is charged to the participant.
• Hydrate before, during and after class, especially in Sweat.
• Phones stay on silent and are not used in the room. Photographing or filming other participants without their consent is not allowed.
• Be respectful of other participants, instructors and the team. Abusive or disruptive behaviour may lead to removal from the class and, if repeated, to closure of your account without refund.
• Changing rooms and lockers are available for the duration of your visit. Lost property is kept for [PLACEHOLDER: 30] days.

11. Sip — the café

Products from Sip are consumed on the premises or taken away and are paid for when ordered. Ingredient lists and allergens are available on request; please tell the team about any allergy or intolerance before ordering. Prices displayed in the café are in RON and include VAT.

12. Photography and filming

Photographs or video may occasionally be taken in the studio for promotional use on Florit’s website and social media. You will be told in advance. Images in which you can be identified are used only with your prior consent, which you can withdraw at any time by e-mailing [email protected]; withdrawal does not affect material already published before it, but we will make reasonable efforts to remove it.

13. Limitation of liability

Florit is not responsible for the loss, theft or damage of personal belongings left in the studio, including in changing rooms or lockers.

Florit, its managers, instructors and contractors are not liable for injuries or damage suffered while taking part in activities, except where caused by gross negligence or intent. You take full responsibility for your state of health, for how you perform the exercises, for not following the instructions given, for improper use of equipment and for taking part with undeclared conditions or limitations.

Nothing in this document limits Florit’s liability where the law does not allow it to be limited.

14. The website

The content of floritbucharest.com — text, photographs, illustrations, logo and graphic elements — belongs to Florit or is used under licence and may not be reproduced without written consent. Information on the site may be updated at any time. Bookings and payments are made through the Glofox platform, which has its own terms of use; the website links to it but does not operate it.

15. Personal data

How we process your data is described in the Privacy policy. Our use of cookies is described in the Cookie policy.

16. Complaints and disputes

Any complaint or suggestion can be sent to [email protected]. We reply within 30 days.

As a consumer you may also contact the National Authority for Consumer Protection (ANPC), anpc.ro, the alternative dispute resolution platform SAL (anpc.ro/ce-este-sal) and the European online dispute resolution platform ODR (ec.europa.eu/consumers/odr).

These terms are governed by Romanian law. Disputes that cannot be settled amicably fall under the jurisdiction of the courts of Bucharest.

17. Changes to these terms

Florit may change these terms. The current version is published on the website with the date of its last update. Changes affecting active memberships are communicated by e-mail at least 15 days before they take effect. Continuing to use the services after publication means you accept the updated terms.
